Terms & Conditions of صيدلية أريب
Welcome to صيدلية أريب. These terms are written to be clear and fair and to protect everyone: you, us and our partners. By tapping "I agree" or using the platform you accept them in full.
1. Who we are
1.1 The platform (app, website, control panel) is operated by [اسم الشركة القانوني], commercial registration [رقم السجل التجاري], licence [رقم الترخيص], address جنزور - الغيران ("Areeb", "we").
1.2 The platform is Areeb Pharmacy's online store: products offered to customers are sold by Areeb Pharmacy directly, from its own stock.
1.3 Areeb also runs a separate wholesale market for licensed pharmacies and medicine companies under the Wholesale Account Terms. If an item from another seller is ever offered, that seller will be named clearly on the item and is responsible for its licence and for the source, conformity, expiry and storage of its products.
2. Eligibility and account
2.1 You must be 18 or older with full legal capacity. A guardian may order for a minor under the guardian's responsibility.
2.2 You confirm that all information you give (name, phone, address, city, prescriptions, pharmacy and licence details) is true, complete and current; you alone bear the consequences of wrong or missing information.
2.3 Your account is personal; you are responsible for your password and everything done through your account.
2.4 We may suspend an account or refuse an order where we suspect a breach of these terms, the law or patient safety.
3. Health information is not medical advice
3.1 Product descriptions, ingredients, images and other content are general information only, not a diagnosis, prescription or substitute for a doctor or pharmacist.
3.2 Buying and using a product is your decision. You must read the leaflet, follow dosing and consult your doctor or pharmacist before use — especially in pregnancy, breastfeeding, for children, the elderly, chronic illness, allergies or other medicines.
3.3 Images are illustrative; packaging may differ.
3.4 Medicines and prescriptions are governed by the "Medical Disclaimer & Prescription Policy", which forms part of these terms.
4. Orders, prices, availability
4.1 An order is an offer to buy; the contract is formed when it is confirmed. We may refuse, change or cancel an order (stock, obvious price error, unacceptable prescription, out-of-area address) and refund any payment.
4.2 Prices are in Libyan dinars and may change; the price at confirmation applies.
4.3 Delivery times are estimates.
5. Payment and wallet
Payment methods are governed by the "Wallet & Online Payment Terms". We do not store card details; payments are processed by licensed gateways.
6. Delivery, inspection, returns
6.1 Inspect your order on delivery (items, seals, expiry) and report any issue within 24 hours with photos.
6.2 After delivery, safe storage is your responsibility.
6.3 Returns and refunds follow the "Sales, Delivery & Returns Policy".
7. Acceptable use
No unlicensed resale of medicines, forged or altered prescriptions, fake identities, abuse of offers, hacking, scraping or copying the platform, or abuse of our staff and drivers.
8. Limitation of liability
8.1 We operate the platform with reasonable care, but it is provided "as is" and "as available".
8.2 To the maximum extent permitted by Libyan law, Areeb and its staff are not liable for: harm resulting from your use of a product contrary to the leaflet or medical advice, or from incorrect information you provided; indirect, consequential or moral damages or loss of profit; defects, conformity or origin of independent Sellers' products (borne by that Seller — we will help you claim and refund you where a defect is proven); delays or failures caused by force majeure (roads, communications, power, security conditions, official decisions, bank or gateway outages).
8.3 To the extent permitted by law, our total liability to you will not exceed the value of the order concerned.
8.4 Nothing in these terms limits liability that cannot lawfully be limited (fraud, gross negligence, wilful misconduct) or your mandatory consumer rights under Libyan law.
9. Indemnity
You agree to indemnify Areeb, its staff and partners against claims, losses, fines and reasonable legal fees arising from your breach of these terms, false information or prescriptions, misuse of products or the platform, or breach of law or third-party rights.
10. Intellectual property
The name, logo, design, content and software belong to or are licensed to Areeb. Product trademarks belong to their owners.
11. Privacy
We process data under the "Privacy & Data Protection Policy"; prescription images are stored privately and seen only by authorised staff.
12. Changes
We may update these terms. Material changes will be shown in the app for your acceptance; continued use after they take effect means acceptance. Each version and your acceptance are recorded.
13. Electronic acceptance
Your tap on "I agree" is a binding electronic signature to the extent recognised by Libyan law, and our records (date, time, version, IP address, device) are evidence of it.
14. Governing law and disputes
Libyan law applies. We first try to settle disputes amicably within 30 days of written notice; otherwise the competent courts of طرابلس have jurisdiction.
15. General
If any clause is unenforceable, the rest remain in force and the clause is read in its nearest enforceable form. The Arabic text prevails.
